What Does “NIL” Mean For You?

First . . . You Must Understand The Basics

In July 2021, the U.S. Supreme Court unanimously ruled that the NCAA could not prohibit student athletes from profiting off education-related payments. Soon after, the members of the NCAA voted to allow college athletes to benefit from name, image and likeness (NIL) opportunities, regardless of where their schools are located. For student athletes, this created pivotal shifts in the landscape of collegiate sports, as athletes can now earn money through endorsement deals, sponsorships, and other opportunities previously restricted by NCAA regulations. These pivotal shifts also opened a window of opportunity for high school students to capitalize on their athletic talents.

However, please note that the applicability of NIL laws to high school athletes varies significantly by state. Some states have adopted provisions that allow high school athletes to benefit from NIL opportunities, while others have not. As previously mentioned, recent NIL legislation and regulations have been primarily focused on college athletes, but rules involving the availability of NIL opportunities for high school athletes have been approved in many states, and efforts to further such opportunities are ongoing in several jurisdictions.
